The insurer refuses to pay

If the insurance company refuses to pay, there is only one right solution left

If an insurance company refuses to pay, there is only one right decision left – do not let yourself be deceived and go to court immediately.

Litigation with an insurance company is a complex and unpleasant process. Globally, a three-tier system of legal regulation of insurance has developed, comprising general civil law, special insurance legislation and other regulatory acts. An ordinary person without legal skills is sometimes unable to understand all the subtleties. Almost every insurance company has professional lawyers on staff who have the relevant skills and know the «loopholes» in the legislation.

The right decision when a dispute with an insurance company arises is to turn to professional lawyers specialising in protecting the rights of policyholders. Lawyers know how insurers work from the inside, which makes it possible to achieve the desired result at the lowest cost while defending your interests.

When applying to an insurer for payment of insurance indemnity, the specifics of each type of insurance should also be taken into account.

The main problems that arise when dealing with an insurance company include:
  • Refusal to pay insurance indemnity;
  • Delaying the payout;
  • Understating the amount of the insurance payout.
What should you do if the insurer does not pay? How can you make the insurer pay?
First, you can try to settle the matter out of court.

1. You need to competently draw up a pre-trial claim to the insurance company, a complaint to the Financial Supervision Committee and other necessary documents. If this does not resolve the problem, you need to move on to resolving it in court.
2. Practice shows that with a competent approach, most refusals can be successfully challenged in court, making the insurer also reimburse the legal costs incurred (state duty, lawyer's fees, additional expert examination, etc.) and pay interest for late payment of insurance indemnity.

Remember, time works in favour of unscrupulous insurers: the sooner you seek help, the sooner you will be able to receive insurance indemnity.

You can get advice from a lawyer or an insurance broker listed in the association's registry.
