If a person has fled the scene of an accident

Insurance Payments Guarantee Fund JSC announces that, for road traffic accidents occurring on or after 1 October 2008, compensation is payable to victims who have suffered serious bodily injury and to relatives of those killed.

Payments are made only where the person responsible for the accident has fled the scene.

To receive compensation, victims must submit to the Fund a complete set of documents in accordance with current legislation:

  • an application for compensation of harm in free form;
  • a document from the authorities of the Ministry of Internal Affairs of the Republic of Kazakhstan confirming the occurrence of the event, i.e. that the person who fled the scene of the accident and is responsible for causing harm to the victim has not been identified;
  • a copy of the report of the healthcare organisation where the victim received medical care in connection with the serious harm to health caused by the accident, stating the nature of the victim's injuries, the diagnosis and the period of temporary incapacity for work;
  • a copy of the report of a medical and social assessment or forensic medical examination institution;
  • a notarised copy of the victim's death certificate (if the victim has died);
  • a document confirming the right of the person entitled to compensation for harm under the legislative acts of the Republic of Kazakhstan (if the victim has died);
  • documents or copies thereof confirming funeral expenses (if there are no relatives);
  • a copy of the applicant's (recipient's) identity card;
  • bank details for the transfer of funds.

Please note that, under Article 940 of the Civil Code of the Republic of Kazakhstan, in the event of the victim's death, the right to compensation belongs only to persons unable to work who were dependants of the deceased or who, on the date of death, were entitled to receive maintenance from the deceased; a child of the deceased born after the deceased's death; and one of the parents, the spouse or another family member, regardless of their capacity to work, who does not work and cares for the deceased's dependent children, grandchildren, brothers and sisters under fourteen years of age, or who have reached that age but, according to a medical report, require outside care due to their state of health.

Victims may apply to the Fund within one year of the road traffic accident.
